Privacy Statement: Protecting Your Health Information

During our work together, it is necessary to create a file. This is also a legal duty imposed by the WGBO. Your file contains personal information, notes about your status and progress, and other information related to aspects of therapy. Insight Art & Therapy ("I" or "Me") understand the sensitive nature of your health information and am committed to protecting your privacy. As your therapist, I am the only one with access to the data in your file. This Privacy Statement ("Statement") outlines how I collect, use, disclose, and safeguard your health information.

What information do I collect?

I collect health information relevant to providing therapy services. This may include:

  • Personal details like your name and contact information.

  • Information about your mental health history, including diagnoses and past treatments.

  • Details about your current concerns and goals for therapy.

  • Progress notes and treatment records created during therapy sessions.

  • Information from a GP or other provider that I have obtained with your consent.

I only collect information necessary for your therapy and that you voluntarily share with me.

How do I use your information?

I use your health information to:

  • Deliver and manage your therapy services effectively.

  • Communicate with you about appointments, reminders, and administrative matters.

  • Track your progress and adjust your treatment plan as needed.

  • Maintain accurate records for billing and insurance purposes (if applicable).

  • Comply with legal or regulatory requirements, such as mandatory reporting.

Sharing your information

I will never share your health information with third parties without your explicit consent. I may disclose your information in limited circumstances, such as:

  • With your written authorization, to consult with other healthcare providers involved in your care.

  • In emergencies, when necessary to protect your safety or the safety of others.

  • During supervision and/or intervision, only in an anonymous form

  • As required by law, such as court orders or mandated reporting of specific conditions.

  • Mandatory reporting to government associations like the IGJ in emergency or violent situations.

  • In cases of child abuse, elder abuse, domestic violence, or other forms of violence, I am required to report according to the Veilig Thuis Reporting Code.

Your privacy rights

You have important rights regarding your health information:

  • Access: You can request to review and obtain a copy of your therapy records.

  • Correction: You have the right to request that I amend any inaccurate or incomplete information.

  • Restrictions: You can request limitations on how I use or disclose your information, and I will consider your request.

  • Confidentiality: You can choose how I communicate with you about your information (e.g., by mail or phone).
     

Invoices

If an invoice is requested, the following information may be necessary to share:

  • Your name, address and place of residence

  • Your date of birth

  • Your BSN or customer number (if required by law)

  • The date of treatment

  • A brief description of the treatment

  • The cost of the session
     

Security measures

I take robust precautions to safeguard your health information from unauthorized access, disclosure, alteration, or destruction. These include secure storage practices and technology safeguards.

Retention of information

The information I keep may consist of emails, text messages, appointments, your personal data (address, email, phone number, etc.), payment records, assessments, session notes, photos, session recordings, or other session materials. Any electronic data is held on password protected devices.

I will retain your health information for as long as necessary to provide you with care, comply with legal requirements (GDPR) , or for legitimate business purposes (e.g., recordkeeping). Any non-essential records will be deleted or destroyed. This data in the client file will remain as required by the treatment agreement law for 15 years.

Changes to this statement

I may update this Privacy Statement periodically. Any changes will be posted on the website. I encourage you to review this Statement regularly to stay informed.

When do you apply this privacy statement?

This privacy statement applies to all personal data that I process and to all domains related to me. This concerns the personal data of everyone who has ever had contact with me or visited my website, such as visitors, customers and business contacts. Personal data is all data that can be traced back to you as an individual, such as your name, telephone number, IP address, customer number or web browsing behavior. Whose data do I use?

I process the personal data of everyone who has had contact with me or visited my website. These include visitors, private customers, business customers and contact persons of my partners.

How do I get your data?

I receive the data directly from you as soon as you:

  • fill in data on my website

  • contact with me by mail, telephone, e-mail, chat, or other means give permission for its use to one of my partners

  • during intake and ongoing work together

 

What data do I use?

  • Personal Data: This data identifies you as an individual and may include your name, contact information (email address, phone number), and any information you voluntarily share in forms or consultations. I only collect personal data that is necessary to provide my services or that you explicitly choose to provide.

  • Non-Personal Data: This data does not identify you and may include your IP address, browser type, operating system, referring website, pages you visit on my website, and the time and duration of your visit. We collect this data automatically through website analytics tools to improve my website and user experience.

  • Communicate with you about your appointments, administrative matters, and therapy sessions.

  • Improve the quality of my services and website.

  • Analyze website traffic and usage patterns.

  • Comply with legal and regulatory requirements.

 

How long do I keep your data?

I keep your personal data for as long as I am required to do so by law and for as long as necessary for the purpose for which I use your data. For example, as long as you are a client, I store your data according to the statutory retention period of seven years. After that, I only keep your data for statistical purposes and to handle any complaints or legal matters. Who do I share your data with?

I may give your personal data to others. I only do this if:

  • I have received your permission to use your personal data

  • In extraordinary circumstances like those described above

 

Where do I store your data?

I process your data within the European Economic Area. This means that I also store your data within the EEA. In some cases, your personal data will be processed outside the EEA. For example, I use Wix and Google to store and process your information. Unfortunately, the rules in many countries do not always offer the same protection of personal data as in the Netherlands. That is why I have ensured that your personal data in that case is just as well protected as it is here. This way your data remains safe. How safe is your data?

I have done a lot to protect your data as well as possible, both organizationally and technically. I have secured my systems and various means of communication to ensure that your data does not end up in the hands of others. Your data is therefore safe with me. I also ensure that your data is only used by people who have received permission from me. If you have any questions about the specific method of securing, please contact me.

When I share your data with others, they are also obliged to treat it with the same care as I do. If you notice that this is not the case, please let me know.

 

What are your rights?

Because I use your personal data, you have various rights. I have listed these rights for you below.

  • Right to information

I must explain to you in an understandable and clear manner what I do with your data and what control you have over it. That is why I explain in detail in this privacy statement what data I collect from you and how I handle your data.

  • Right to access

You may always ask me to view the data I hold about you.

  • Right to correction

You may ask me to have your data corrected if it is incorrect or incomplete.

  • Right to object

You may object to the processing of your data if you do not agree with the way I handle your personal data. This right applies to the data I use for direct marketing. You can indicate to me that you no longer wish to receive emails or messages from me. This also applies to personalized recommendations on my website.

  • Right to data portability

If you are a client or if you have given permission for the use of your data, you may ask me to send you the digital data I have about you. This way you can transfer that data to another organization if you wish.

  • Right to restriction

You may ask to limit the use of your data. This means that in certain cases I may only store your data but not use it.

  • Right to be forgotten

You may ask me to delete all the data I have about you. I will then delete all data that can be traced back to you. In some cases I cannot or may not yet delete your data. For example, I have to keep some data for 7 years for the tax authorities.

  • Right to submit a complaint

You may submit a complaint about the way in which I handle your data. If you have a complaint, I will be happy to resolve it for you. To do so, please contact me. You may also submit your complaint to the Dutch Data Protection Authority. Of course I hope that it does not come to that, but if it's necessary you can also go to court. In that case, the court in the place of business of Insight Art & Therapy is the one which will handle your complaint.

 

How do I submit a request or complaint?

You can submit your request or complaint to me by sending a mail to hello@insightartandtherapy.com. I process every request or complaint within 30 days. If you submit multiple applications or complaints or if you submit a complex request or complaint, this may take more time. In that case, I will contact you within 60 days at the latest. I may ask you to identify yourself. In that case, I will ask you to submit certain information to ensure that you are the correct person whose personal data is.

 

What rules apply to this privacy statement?

This privacy statement must meet several conditions. These conditions can be found in particular in the Dutch General Data Protection Regulation. In addition, the general rules that apply under Dutch law apply to my privacy statement.

 

Which cookies do I use?
